As per the last revision, the stamp duty charges levied for purchasing a property in Bangalore are three percent for properties priced between Rs 21 lakh and Rs 45 lakh, and two percent for properties below Rs 20 lakh. But what is the stamp duty in Bangalore on higher budget segments?

The stamp duty and registration charges in Bangalore are different from those in other cities and States. Generally, stamp duty charges are between three percent and five percent of the market value of the property, and registration charges are between one percent and three percent.

To boost the real estate sentiment in the State, the Karnataka government passed an amendment to the Stamp Act, 1957, to slash the stamp duty rate on properties priced between Rs 21 lakh and Rs 45 lakh. All such properties will attract a three percent stamp duty. Whereas stamp duty for properties under Rs 20 lakh is two percent. However, the rebate is applicable only on first-time property registration.

The Karnataka government has set a target to collect departmental taxes. The annual target for the collection of tax/revenue for the Stamps and Registration department is Rs 19,000 crore. The government has also proposed the implementation of a scientific guidance value system through the K-GIS Technology of Stamps and Registration department. Besides, the rebate of 10 percent on the guidance value has been discontinued.

How much is the stamp duty in Bangalore?
A buyer is liable to pay 5.6 percent (for properties above Rs 45 lakh) stamp duty in urban areas on the sale agreement, along with a 10 percent cess and two percent surcharge, calculated on stamp duty. In areas under Village Panchayat, the surcharge is three percent, and thus the total stamp duty value is 5.65 percent.

While stamp duty tax is levied by the State governments on the property, basis its market value; the registration charge is levied for the registration of documents under the Registration Act, 1908. These charges, although compulsory, vary from state to state depending upon city laws.

Imagine Mr X bought a 1,000 sq ft plot in Bangalore for Rs 5,000 per sq ft. Coincidentally, this is also the guidance value in the area.Therefore, the guidance value of the property= Rs 5,000 x 1,000 = Rs 50 lakh Stamp Duty= 5.6 percent of saleable value (Rs 50 lakh) = Rs 2,80,000 Registration Charges= 3 percent of saleable value (Rs 50 lakh) =Rs 1,50,000
Total Stamp Duty and Registration charges= Rs 2.8 lakh + Rs 1.5 lakh = Rs 4.3 lakh
Mr X has to pay a total of Rs 54.3 lakh (Rs 50 lakh + Rs 4.3 lakh) to get the property ownership.

All property buyers in Bangalore need to pay a two percent surcharge and 10 percent cess on stamp duty, for properties priced above Rs 35 lakh. For rural areas, the surcharge is three percent. These charges are calculated on stamp duty cost and not property value.
